INTENDED DELIVERY DATE (IDD) and TURNAROUND. The IDD is only an "intended/estimate" date and although we make everything possible to deliver on said date due to the nature of the business (your job may require more time due to unforeseeable factors or finishing services added) we do not guarantee it. We will not issue refunds or credits if a job is delivered after the intended delivery date.
CUSTOMER LAYOUT. You are 100% responsible for the accuracy of your layouts. Please proofread all layouts carefully. US Presort reserves the right to refuse to print any material that US Presort determines, in its sole discretion, is illegal or inappropriate for any reason for distribution in the United States Postal Service mail stream. If your material is found unacceptable, you will be notified promptly and allowed to change the content or layout to fit the requirements. To comply with USPS® regulations, we are obligated to provide the content of the enclosed mail pieces for their approval. All materials which contain foreign language have to be accompanied by a translation on official company letterhead.
US PRESORT LAYOUT. You are satisfied with the document design and layout. You certify that you are legally authorized to utilize any design, art and/ or photograph(s) being supplied to US Presort for fulfilling this order. Further, you guarantee, to hold harmless and agree to defend US Presort from any suit, claim or demand arising from your reproduction or use of this material. You are entirely RESPONSIBLE for final proof and layout approval before the printing process. US Presort is NOT LIABLE for errors in a final product caused by any of the following reasons: 1. Omitted, Mistyped or Misspelled Words, Grammar, Punctuation. 2. You understand that job will print EXACTLY as it appears on the proof (excluding color as described in the next section) and that no changes can be made once the proof is approved. No orders are eligible for free-of-charge rerun for the said reasons.
COLOR PROOFING & MATCHING. Screen proofs will predict design layout, text accuracy, image proportion, and placement, but not color or density. The color on your monitor can not reproduce the printed piece correctly. The colors on the computer screen are brighter than they will appear when they print. Therefore, US Presort is not liable for color matching or ink density on screen proofs. US Presort will try it's best to match the gradient density of each color, US Presort is not liable for the final appearance of a color. Application of UV Coating may affect or change the appearance of the printed colors. We are not liable for the final color appearance of a UV product/s. Color variations are within the industry standards. No reprint will be honored for color variation.
PAYMENT. Due the nature of the business and our quick turnaround, all orders must be prepaid. The fees for US Presort products and services, which include the cost of developing a campaign, design, copywriting, processing, printing, shipping and/or mailing, and any other charges applicable, are due and payable together with the submission of order. Limited exceptions are extended to pre-approved Customers. The exceptions are limited to the design, concept and pre-production portion of the job. All stock ordering, mailing services and postage related fees must be prepaid. Please note that no orders will be processed or mailed until an approved and signed order. An order paid in full indicates the order has been approved and the terms of the order agreement has been accepted. Once a job has been approved by a Customer and the order is being processed, no changes to the artwork files, job options, or production turnaround time are allowed. We accept all major Credit Cards, Checks, ClearXchange QuickPay, E-Checks, Bank Transfer or Cash. A 3% processing fee will be added to all postage and discounted service amounts paid with Credit Card. To avoid the fee for credit card processing, please mail a check, or use the QuickPay, Wire transfer or E-Check for time sensitive jobs. All returned checks will be charged an additional fee of $35.
MAILING SERVICES TERMS. US Presort is responsible for data processing and printing only, and does not archive, transfer, store, or distribute Customer's mailing list(s). Customer's mailing list(s) will not be sold or used in any other way or offered to any other party. A Mailing List Non-Disclosure Agreement will be signed and provided per your request. Mailing pieces provided by a Customer: 1. Must have preprinted our indicia (permit) as shown in the order. If indicia is not preprinted, additional charges may apply. 2. Must not have any coating on the postage side to allow for addressing. 3. To avoid any mistakes which will result in additional charges, please email the layout to us for review and approval. Leftovers (if requested) will be sent or delivered after mailing.
PROOF OF MAILING. A Certificate of Mailing (form PS 3606-D) will be provided only if requested and purchased before the order is approved. The Certificate of Mailing cannot be obtained once the job has been mailed! NO EXCEPTIONS. Customer needs to order and purchase a certificate for each drop if the job is split to more than one drop.
MAILING LIST RENTAL. US Presort grants Customer a limited, nonexclusive, nontransferable license to use the List ordered. Each List may be used for the number of times specified and permitted.
RESTRICTIONS FOR LIST RENTALS. A) Single use lists will not be distributed to the Customers. B) Lists ordered with the proper fee for multiple use: Customer is allowed and declares that it will use, the List for the number of uses and within the time permitted, 12 months maximum for basic lists and 6 months or less for some special lists. The List will be used only for direct mail advertisement and surveys or for internal analysis. Seed names will be included to identify unauthorized use. C) Customer agrees that it will use the List provided under this AGREEMENT following all Federal, state, and local laws. D) Customer represents and guarantees that it will not resell, rent, or disclose the List to any third party, for any purpose whatsoever.
DATA PROCESSING Even though the duplicates removal from a Customer's supplied list is a part of our standard data processing, it will not be executed unless requested by the Customer before the order approval. National Change of Address (Move update): to comply with the USPS® regulations, we process every list supplied through the National Change of Address Database. We provide such service at no extra charge, however if the client requires the updated file to be returned to them, an additional fee will apply.
CANCELLATIONS. Due to the fast services, cancellations are not allowed after the order is approved. If the job is canceled before approval, any accumulated hours for: concept, writing, graphic design, etc. and administrative or payment fees will be subtracted from the refund.
INDEMNITY and DAMAGES. US Presort will not be held liable, in no event, for incidental or consequential damages or compensation of present or prospective profits, payments or investments. Any claim or lawsuit associating with this Agreement must be filed within six (6) months of date of the claimed breach of the terms by US Presort.
STANDARD MAIL CLASS. Certain materials such as bills and statements of account must be mailed using only First-Class Mail (Details in Domestic Mail Manual (DMM) section 133.3. Nonprofit rate mail is Standard Mail. Delivery Expectations: USPS® delivery times for Standard Mail are unavoidably inconsistent and can range from 3 to 27 days. There are no reliable service rules available for Standard Mail.
LIABILITIES. US Presort responsibility is limited to preparing your mailing and completing delivery to the U.S. Postal service (USPS®). US Presort delivers to all Destination Sectional Facilities of the U.S. Postal Service in Tri-State Area (NY-NJ-CT). In no event shall US Presort be liable for USPS® performance failures or delivery delays. Under no circumstances shall we be liable to any Customer’s loss of business, profits, postage or other consequential damages as a result of services provided. Please refer to FAQ section of our website for details.
LEFTOVERS/ CUSTOMER MATERIALS. If any CUSTOMER's materials remain in our shop beyond 30 days without disposition instructions, it will be recycled.
