US Presort Terms and Conditions
These Terms and Conditions apply to products and services provided by US Presort, including direct mail, printing, mailing lists, data processing, design, lettershop, presort, postage preparation, shipping, and related services.
All quotes are based on the specifications provided at the time of quoting, including quantity, format, paper/stock, printing, finishing, data processing, postage class, delivery method, and requested timeline. Pricing may change if specifications, files, mailing data, quantities, postage requirements, or production needs change.
An order is considered approved when the customer confirms the order, approves the proof, signs an order agreement, pays the required deposit or balance, or otherwise authorizes US Presort to begin work. Once an order is approved and production or mailing preparation has started, changes may not be possible and may require additional charges.
Any production date, mailing date, in-home date, or intended delivery date is an estimate unless expressly stated in writing as guaranteed. US Presort makes reasonable efforts to meet requested timelines, but turnaround can be affected by customer delays, file issues, proofing delays, finishing requirements, material availability, USPS processing, weather, holidays, or other conditions outside our control.
US Presort is not responsible for refunds, credits, lost business, or consequential damages if a job is completed, mailed, or delivered later than an estimated or intended date.
The customer is responsible for the accuracy, legality, and completeness of all customer-supplied artwork, text, images, mailing lists, offers, disclaimers, logos, trademarks, and other materials. Customers should proofread all layouts carefully before approval.
US Presort may refuse to print or mail material that it determines, in its sole discretion, may be illegal, misleading, offensive, inappropriate, non-mailable, or unsuitable for entry into the USPS mail stream. If material is found unacceptable, the customer will be notified and may be required to revise the content or layout.
The customer represents that it has the legal right to use all designs, photographs, images, logos, trademarks, mailing data, and other materials supplied to US Presort. The customer agrees to defend, indemnify, and hold US Presort harmless from claims, demands, losses, or expenses arising from the customer’s use or reproduction of such materials.
When US Presort provides design, layout, copywriting, or prepress services, the customer is responsible for reviewing and approving the final proof before printing or mailing. Approval of a proof means the customer accepts the design, layout, spelling, grammar, punctuation, offer details, dates, phone numbers, URLs, addresses, quantities, and all other visible content.
Jobs print as approved. US Presort is not responsible for errors in the final product that appeared in an approved proof, including omitted words, misspellings, grammar, punctuation, incorrect contact information, incorrect offers, or layout choices approved by the customer. Changes cannot be guaranteed once a proof has been approved and production has started.
Digital or screen proofs are intended to show layout, text, positioning, image placement, and general appearance. They are not exact color proofs. Monitor settings, paper stock, coating, printing process, and finishing can affect final color and density.
US Presort makes reasonable efforts to produce color within normal industry standards, but exact color matching is not guaranteed unless a specific paid color-proofing or color-matching process is agreed to in writing before production. Coatings, including UV coating or other finishes, may affect the final appearance of printed colors. Reasonable color variation is not grounds for a free reprint, refund, or credit.
Unless otherwise agreed in writing, orders must be prepaid before production, mailing preparation, postage purchase, or mailing. This includes printing, mailing services, postage, stock, finishing, design, data processing, list rental, shipping, and other job-related charges.
Pre-approved customers may receive limited billing terms for certain services, but postage, stock orders, mailing services, and third-party costs may still require prepayment. No job will be mailed until all required approvals and payments are received.
Accepted payment methods and processing fees may vary. Any returned check, failed payment, chargeback, or collection-related cost may result in additional fees and may delay production or mailing.
US Presort’s responsibility for mailing services is limited to preparing the mailing according to the approved specifications and delivering the mail to USPS or an applicable USPS entry point. US Presort is not responsible for USPS delivery delays, USPS processing decisions, lost mail after acceptance by USPS, or USPS service interruptions.
Customer-supplied mail pieces must meet USPS requirements and the specifications approved for the job. If indicia, addressing area, coating, size, weight, folds, tabs, inserts, or other mail-piece characteristics do not meet requirements, additional charges, redesign, reprinting, or reprocessing may be required.
Customers should submit mail-piece layouts for review before printing outside of US Presort when US Presort will be responsible for mailing. US Presort is not responsible for additional costs caused by customer-supplied pieces that are not compatible with USPS requirements or approved mailing specifications.
US Presort treats customer-supplied mailing lists as confidential business information. Customer-supplied lists will not be sold, rented, transferred, or used for purposes unrelated to the customer’s order. A separate non-disclosure agreement may be provided upon request.
Data processing may include formatting, deduplication, CASS/NCOA processing, address standardization, presort preparation, and other services needed for the mailing. Deduplication, segmentation, suppression, or return of updated data files should be requested before order approval. Additional fees may apply.
To comply with USPS move-update requirements when applicable, customer-supplied lists may be processed through the National Change of Address database or another accepted USPS move-update method. Address updates, undeliverable records, duplicate records, and final mail quantities may vary from the customer’s original file.
When a mailing list or data file is rented, licensed, or sourced through US Presort or a third-party data provider, the customer receives only the usage rights specified for that list or campaign. Unless expressly agreed in writing, rented or licensed lists are for direct mail use only and may be limited to a single use or to a defined number of uses within a stated time period.
The customer may not resell, rent, copy, disclose, transfer, or otherwise distribute rented or licensed list data to any third party. Seed names or tracking records may be included to detect unauthorized use. The customer is responsible for using all list data in compliance with applicable federal, state, and local laws.
Certificates of Mailing, postage statements, drop documentation, or other USPS documentation may be available only if requested before the mailing is approved and entered. Some USPS forms or certificates cannot be obtained after the mailing has been submitted to USPS. Additional fees may apply.
Certain materials, including bills, statements of account, invoices, and other matter required to be sent as First-Class Mail, may not qualify for USPS Marketing Mail. The customer is responsible for disclosing the nature of the mailing so the appropriate mail class can be selected.
USPS Marketing Mail, Nonprofit Marketing Mail, First-Class Mail, EDDM, and other USPS services have different eligibility rules, preparation requirements, postage rates, and delivery expectations. Delivery times are estimates and are not guaranteed by US Presort. USPS rules, rates, and service standards may change.
Because many jobs move quickly into design, printing, data processing, stock ordering, postage preparation, or mailing, cancellations are not allowed after order approval unless US Presort agrees in writing. If an order is canceled before approval or before production begins, any accumulated design, copywriting, administrative, processing, material, payment, or third-party fees may be deducted from any refund.
Any leftover printed pieces, stock, inserts, or customer-supplied materials will be handled according to the job instructions. If materials remain at US Presort for more than 30 days without written disposition instructions, they may be recycled or discarded. Storage, delivery, or shipping charges may apply.
To the fullest extent permitted by law, US Presort’s liability is limited to the amount paid by the customer for the specific product or service giving rise to the claim. US Presort is not liable for lost profits, lost business, lost postage, loss of goodwill, indirect damages, incidental damages, consequential damages, or damages caused by USPS performance, customer-supplied errors, late approvals, defective files, inaccurate mailing data, or third-party delays.
Any claim related to an order must be submitted in writing within a reasonable time after delivery, mailing, or discovery of the issue. Claims filed more than six months after the date of the alleged breach or issue may be rejected to the extent permitted by law.
These Terms and Conditions apply to US Presort products and services unless a separate written agreement signed by US Presort states otherwise. US Presort may update these terms from time to time. The terms in effect at the time an order is approved apply to that order.
